Do you need a Data Protection Officer in the UAE or Saudi Arabia?
Whether you must appoint a Data Protection Officer (DPO) depends on the law that applies to you and on what your organisation does with personal data. In summary:
- UAE PDPL (Federal Decree-Law No. 45 of 2021): a DPO is required in specified situations, including processing that involves a systematic and overall assessment of sensitive personal data, profiling or automated processing, or processing of large volumes of sensitive data, and processing that relies on new technologies with a high risk to individuals.
- DIFC Data Protection Law (Law No. 5 of 2020): a DPO is required for public bodies (other than courts) and for controllers and processors carrying out high-risk processing on a systematic or regular basis.
- ADGM Data Protection Regulations 2021: DPO obligations apply in comparable circumstances, such as regular and systematic monitoring or large-scale processing of special categories of data.
- Saudi PDPL and its Implementing Regulations: a DPO must be appointed by certain controllers, for example where core activities involve large-scale or regular monitoring of individuals or processing of sensitive data.
- GDPR (Articles 37 to 39): a DPO is mandatory for public authorities, for large-scale regular and systematic monitoring, and for large-scale processing of special categories. The DPO can be an external service provider.
Many organisations that are not strictly required to appoint a DPO still choose to, because regulators, customers and enterprise buyers expect a named point of accountability. If you are unsure, our gap analysis will confirm which obligations apply to you. This page is general information, not legal advice.

DPO-as-a-Service or an in-house DPO?
An outsourced DPO gives you senior expertise across several regimes without a full-time salary. It also avoids the conflict-of-interest risk that arises when an internal employee who decides how data is used is also the person overseeing compliance. An in-house hire can make sense for very large organisations with constant, high-volume processing. Many of our clients start with an external DPO and review the arrangement as they grow.
Frequently asked questions
Can a DPO serve more than one law at once?
Yes. One DPO can cover UAE PDPL, DIFC or ADGM rules and GDPR for the same organisation, provided the scope of the appointment is clear and the DPO has the independence and expertise each law expects.
Does an external DPO satisfy the legal requirement?
GDPR expressly allows a DPO to be an external service provider. Other regimes have their own conditions, so we confirm the position for your sector and jurisdiction when we scope the engagement.
Is the DPO personally liable for compliance?
No. Responsibility for compliance stays with the organisation as controller or processor. The DPO advises, monitors and reports.
What do we need to provide to get started?
A short overview of your business, the personal data you handle and any existing policies or contracts. We take it from there.
